MOMCIE Terms and Conditions

Welcome to MOMCIE—we are so happy to have you here. We want you to shop safely and with confidence. These terms and conditions therefore clearly explain what you can expect from us and what we expect from you when you visit our online store or make a purchase.

Article 1 – Who may use our online store?

By using our online store, you confirm:

  • that you are 18 years of age or older, or have permission from a parent or legal guardian;

  • that the information you provide is accurate and up to date;

  • that you are responsible for the use of your account.

Your account is personal. If you share it with someone else, you remain responsible for all activity carried out through your account.

Article 2 – Our products

We make every effort to display our products as accurately as possible. However, colours or details may vary slightly depending on your screen. We reserve the right to:

  • update product information;

  • temporarily or permanently remove products from our range;

  • set purchase limits, for example per household.

Our products are intended for personal use and not for resale.

Article 3 – Orders

Your order becomes final once we have confirmed it and your payment has been processed. We may refuse or amend orders, for example if we suspect misuse.

Would you like to cancel your order? Please let us know as soon as possible. Once an order has been processed, we may no longer be able to stop it. Returns are accepted in accordance with our Returns Policy.

Article 4 – Prices and payment

  • Prices include VAT but exclude shipping costs, unless otherwise stated.

  • We reserve the right to change prices or amend promotions.

  • You are responsible for providing accurate payment and address details.

We accept various secure payment methods. The transaction is only complete once the payment has been received in our account.

Article 5 – Shipping information

We do our utmost to deliver your order as quickly as possible. Please note that delivery times are estimates.

From the moment the shipment is transferred to the carrier, the risk passes to you. Are you experiencing a delivery problem? Please contact us and we will help you find a solution.

Article 6 – Intellectual property

All content on our website, including photographs, text and logos, is owned by MOMCIE or our partners or licensors. You may not copy, edit or distribute any content without prior written permission.

Article 7 – Third-party tools

We sometimes use third-party tools, such as Shopify features. These tools are provided “as is” and without warranty. Your use of them is at your own risk. Always review the terms and conditions of the relevant third party.

Article 8 – Links to other websites

Our online store may contain links to other websites. We are not responsible for the content, security or operation of these external websites. Always read their terms and conditions and privacy policies before submitting information or placing an order.

Article 9 – Our relationship with Shopify

Our online store is hosted by Shopify. Shopify collects certain information to help operate our store. However, Shopify is not a party to your purchase. Your agreement is exclusively with MOMCIE.

Article 10 – Privacy

We process personal data whenever you place an order. We handle this information carefully and only as described in our Privacy Policy. For further information, we also refer you to Shopify’s privacy policy.

Article 11 – Feedback and reviews

We value your opinion. If you provide us with feedback, whether by email, review or otherwise, you give us permission to use it to improve our services. We may, for example, display this feedback on our website or use it for marketing purposes.

Article 12 – Errors and changes

We make every effort to keep our information accurate, but typographical errors may occur. We reserve the right to correct errors and cancel orders if information, such as a price or stock status, is incorrect.

Article 13 – Permitted and prohibited use

You must use our online store honestly and responsibly. You may not use the website for:

  • illegal or harmful activities;

  • distributing spam, viruses or inappropriate content;

  • infringing our rights or the rights of others.

In the event of misuse, we reserve the right to block your account or deny you access.

MOMCIE is not liable for indirect loss, loss of profit or consequential loss. To the extent permitted by law, our liability is limited to the amount you paid for your order.

Article 18 – Severability

If we do not immediately exercise a right, this does not mean that we waive that right.

Article 20 – Assignment

You may not transfer your rights or obligations under these terms and conditions without our permission. We may transfer ours, for example in the event of a takeover.

Article 21 – Governing law

These terms and conditions are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.

Article 22 – Headings

The headings in these terms and conditions are included for convenience only and have no legal effect.

Article 23 – Changes

We may amend these terms and conditions. If we do so, we will publish a new version on our website. The latest version will always apply.
